The Tail 'still wagging the Dog

Labor caucus backs Brown's Territories Rights Bill Bob Brown seems once again to have proven who wears the pants in the Greens on-again-off-again love match with Julia Gillard and Federal Labor.Readers may recall that in early March of this year the Federal Labor caucus backed Brown's Territories Rights Bill only later to have that support overturned when concerned Labor MPs pointed out that the bill would facilitate both same-sex marriage and euthanasia laws in the Northern and Capital Territories.  Following on from that, the Prime Minister publicly declared that she did not support either issue; comments that had some, including this writer, believing that a conscience vote would be allowed which would give us a fighting chance of seeing the bill defeated. The unreasonable Key euthanasia bill

Aug 01, 2011

It has been interesting, and more than a little frustrating to read the comments by some South Australian MPs to the effect that the bill put forward by backbencher, Steph Key isn't about euthanasia but, rather, about giving added protection under the law for doctors going about their normal business (or words to that effect). It might seem obvious, but it needs to be stated that all legislation is about what the bill says and what the bill does; not what anyone tells us it will do.  A cynical retort to that point might be to say, "Well, in that case, why should we listen to what you say it's about?"  Fair point, but judge for yourselves from what follows. But before we look at the legislation itself, just think for a minute: if the bill isn't about euthanasia, why is Phillip Nitschke in Adelaide so often?  Why is he saying that  Continue reading

Reason to thank Dr. Nitschke

Now that's a headline direct from the 'now that I've got your attention' files! I never thought I'd be giving a bouquet to 'doctor death'.  After all, there's nothing that he has said or done in the public eye that I find the least bit agreeable (except, perhaps, the recent picture of his visit with his mother). But Dr. Nitschke has in fact, done us a favour by his grandstanding about setting up a 'killing centre' in Adelaide to take advantage of what he no doubt hopes will be the successful passage of the Key bill through the SA parliament. The Ides of March - dark days in the South Australian parliament

Debate on Steph Key's Euthanasia bill stifled by the stench of subterfuge in the house. The latest euthanasia attempt in the SA Parliament was introduced by backbencher, Steph Key on the 10th of March.  Styled on Health Minister, John Hill's draft from late 2010, the bill would usher in euthanasia on demand and an open season on patients.  The only protection offered by this latest 'kill bill' is for doctors.  Apparently patients don't rate.Private Member's bills such as this usually move slowly with little time allocated during the sitting week and each speech usually followed by an adjournment for either another MP or the completion of the current speech to be heard on another sitting day.  But all conventions were overridden on Thursday the 24th of March when the bill's main supporters rushed through the second reading stage without any opportunity for a dissenting voice to be heard. Hill's Kill Bill - Open season on patients

Readers may recall the eleventh hour intervention by the South Australian Health Minister, John Hill the day before the euthanasia debate that raised serious doubts about the Parnell Bill.  How this affected the outcome of the debate the next day is anybody's guess â but it was certainly a welcome statement that supported our observations.  That same day, however, Mr Hill circulated a draft bill which, we understand, may be tabled in the parliament in the New Year. Mr Hill's alternative is very different in approach to the legislative frameworks adopted by pro-euthanasia MPs over recent years.  We've had bills designed to create stand alone acts and bills that amend existing acts of the SA Parliament but, to my knowledge we have never seen a euthanasia and assisted suicide bill that restricts itself entirely to amending the SA Criminal Code (the Criminal Law Consolidation Act 1935, to be precise). The Hill 'Kill Bill' creates a legal defence against an act of euthanasia or assisting in a suicide for a medical practitioner or for another person who aids a medical practitioner in an act of euthanasia or assisted suicide within Division 1 (homicide) Subsection 13 (manslaughter) of the Act. Parnell Bill Defeated

Nov 26, 2010

Last evening (24th November) the South Australian Parliament's upper house debated the latest euthanasia bill from Greens MLC, Mark Parnell. At the State Election in March of this year changes in personnel in the upper house appeared to have turned that chamber decidedly pro-euthanasia.  However, last night common sense prevailed yet again as the bill was defeated at the second reading 'on the voices'.Mr. Parnell did not call for a recording of the votes.  However, from the speeches given, it was clear that the chamber was split 12 to 9 against the bill or possibly 13 to 8 at best.
